Overview

Eric has extensive experience representing businesses in employment litigation, as well as advising on compliance with California and federal employment laws. He regularly counsels employers on resolving complex workplace issues, including personnel matters and compliance with the myriad legal obligations imposed on employers. Eric's litigation experience spans a broad range of employment disputes. Eric is well-versed in defending employers against wage and hour class and representative actions, including claims brought under the Private Attorneys General Act (PAGA). Eric’s litigation experience also includes defending against single-plaintiff lawsuits involving allegations of discrimination, harassment, whistleblower retaliation, wrongful termination, and failure to accommodate disabilities. A skilled trial attorney, he has secured several jury verdicts in favor of employers and obtained summary judgments in numerous cases, eliminating potential liability for clients.

  • Obtained complete defense verdict at jury trial in case involving claims of wrongful termination and retaliation brought by former employee of an international manufacturing company.
  • Prevailed at arbitration hearing in which large international health insurer brought claims for violation of noncompete obligations against former employee who joined a competing business.
  • Defeated certification of FLSA collective action against a landscaping service provider in alleging underpayment of wages.
  • Obtained summary judgment on former employee's claim for wrongful termination, which was upheld on appeal.
  • Obtained summary judgment for national grocery chain on former employee’s claims of retaliation, failure to accommodate, and wrongful termination.
  • Prevailed on motion for judgment on the pleadings on statute of limitations grounds resulting in favorable termination of lawsuit for a national shipping company.
  • Resolved multiple wage and hour class and representative action lawsuits for employers on favorable terms through mediation.
  • Routinely enforce arbitration agreements against former employees seeking to litigate claims in courts.
  • Persuade EEOC and state fair employment practices agencies to decline to pursue legal claims against employers accused of unlawful employment practices.
