Los Angeles partner Steven Katz comments on the U.S. Supreme Court's recent ruling that a party's right to compel arbitration after litigating doesn't depend on whether the delay prejudiced the other party. This ruling could push employers to seek arbitration more quickly. 

Katz notes that the proper defense strategy is typically moving "for arbitration at the earliest practical point in the litigation."
