Regina Musolino, senior counsel in Constangy’s Los Angeles office, wrote an article published in the August 2024 issue of HR.com’s Legal & Compliance Excellence about reform to the Private Attorneys General Act (PAGA).

Musolino outlined how the reforms will impact employers and employees in the state when the law goes into effect Oct. 1, 2024. Importantly, the changes only apply to PAGA notices filed on or after June 19, 2024.

“The expected revisions to PAGA are extensive and, in some instances, complicated, and much is unknown at this stage how they will play out in the courts,” Musolino said. “For now, particularly given the newly and greatly expanded cure and compliance provisions, we recommend that employers review their policies, practices, and procedures, and consider auditing employee records.”
